Buying Hua Hin property is a decision worth taking slowly. The legal arrangements, the price and the property’s resale prospects all deserve careful thought.
As I write this, a small number of local property owners are finding that purchases made through nominee structures have landed them in serious trouble.
I have sympathy for those affected, but using nominees to get around restrictions on foreign land ownership has never been a sound way to buy. Those restrictions are long established, and the authorities have stepped up checks on suspected nominee arrangements.
Legal options for Hua Hin property buyers
Buying property in Thailand can still work well if you understand the legal arrangements and get independent advice before committing.
Thailand wants to protect its land. Some people will use the current situation as another excuse to post negative comments online and claim Thailand is too risky for buyers. I do not agree.
I am proud that I have never offered a nominee purchase. Thousands of people will have heard me ask: “Why do this illegally when it is so easy to do it legally?”
A properly structured and registered lease can provide rights for the agreed term. Have an independent lawyer explain those rights, the contract’s limitations and what happens when the lease ends.
Buying a villa can still be a good option. The important thing is to understand the arrangements for both the house and the land beneath it.
Do not rush or overpay
My main concern is the number of buyers spending more than they need to.
“We have to act now before it is too late.”
No, you really do not.
I worry that, in five years, some buyers who overpaid will need to sell and discover that the market does not support the price they want.
I often hear: “We paid 15 million baht, but the exchange rate was bad. Now we need 17 million baht just to break even.”
Unfortunately, the market does not care what exchange rate you received. If you paid 15 million baht for a property realistically worth 13 million baht, selling it for 17 million baht may not be possible.
That does not mean everyone loses money when buying in Thailand. It means paying too much at the start can make it harder to recover your money later.
Do your due diligence, take your time, compare similar properties and find a trusted agent. Use an independent lawyer to check the proposed ownership or lease arrangements before you commit.
Where to find value in Hua Hin property
The condo market presents similar problems. A buyer recently approached me after purchasing a newer condo and said they wanted something larger.
That is fine, but first they need to sell their current unit.
“I paid almost five million baht for 33 square metres at the launch party.”
A launch event can create a sense of urgency, but buyers still need to compare prices with similar properties on the resale market.
If that unit is now worth closer to four million baht, it does not mean everyone loses money. It shows why buyers must look beyond the launch presentation and consider what someone else might pay for the property later.
In my view, older condos that can be renovated offer opportunities, as do some newer houses. However, the purchase price is only part of the cost. Renovation, maintenance and ongoing charges also need to fit your budget.
When buying a second-hand home, check whether the owners lived there or used it as a rental. Look closely at its condition and maintenance history. A heavily used or poorly maintained property may require more renovation than expected.
Off-plan housing can also work well, but check the developer’s track record, the contract and the location. A longer construction period does not guarantee rising values.
Better transport connections may benefit an area, but promised infrastructure will not make every development a good investment.
Take your time and get it right
You could save yourself a lot of time and simply come to see me.
As I get older, and yes, I seem to be ageing faster now, I want to work closely with buyers who want to do things properly. That means taking time, searching carefully and weighing up the pros and cons.
I can remain your agent for weeks, months or even years. I am not retiring just yet.
As for buyers who prefer to chase the salesgirl bouncing around a swimming pool in a property video, good luck. I do not look particularly good in a skirt, so I will not try to compete.
I simply want to sell you something I would be proud to own myself.
